Mexican pleads guilty to U.S. agent's murder tied to gun probe

PHOENIX (Reuters) - A Mexican man pleaded guilty on Tuesday to first-degree murder in the 2010 death of a U.S. Border Patrol agent, a killing linked to a controversial U.S. attempt to track gunrunning to Mexico drug cartels.

Manuel Osorio-Arellanes made a deal with prosecutors and entered the plea in U.S. District Court in Tucson in the shooting death of agent Brian Terry in the Arizona borderlands, federal officials said. He could face life in prison, but prosecutors will not seek the death penalty.

Osorio-Arellanes, 36, was one of five Mexican suspects charged in Terry's murder. His death was linked to a U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives investigation that allowed weapons to slip across the border into Mexico.

Two guns found at the remote area north of Nogales where Terry was killed in a shoot-out were traced to the sting operation, dubbed "Fast and Furious."

It remained unclear if the weapons were used in the murder and it is not known which of the five suspects killed the Border Patrol agent in the nighttime gunfight.

Laura Duffy, U.S. attorney for the southern district of California, said the deal represented "an important step in seeking justice on behalf of Agent Terry."

"Agent Terry was killed in the line of duty courageously safeguarding our border," Duffy, who is handling the case, said in a statement. "Our country owes him and his family a great debt of gratitude for his ultimate sacrifice in service to our country."

Osorio-Arellanes is scheduled to be sentenced on January 11. His attorney declined to comment on the plea agreement.

Arizona is a busy corridor for Mexican smugglers hauling marijuana and other drugs north to consumers in the United States.

According to the plea, Osorio-Arellanes admitted to entering Arizona in December 2010 with the others to rob traffickers of their drugs. Then on the evening of December 14, members of the group exchanged fire with agents in the area.

Osorio-Arellanes was wounded in the firefight and was arrested on the night of the shooting, federal prosecutors said.

Authorities offered a reward of up to $1 million in July for information leading to the arrest of the four other men believed to be involved in Terry's killing. Mexican police detained one of those men, Lionel Portillo-Meza, in September. He is awaiting extradition to the United States, prosecutors said.

The border killing sparked an election year firestorm between the administration of President Barack Obama and congressional Republicans, who slammed the government for allowing the program and called on Attorney General Eric Holder to resign.

The Republican-controlled House of Representatives found Holder, the nation's top law enforcement official, in contempt for withholding documents related to the gun-running probe.

Terry's family has filed a $25 million wrongful-death claim against the U.S. government, saying he was killed because federal investigators allowed guns to fall into the hands of violent criminals.

In a statement issued on Tuesday, the family said it was "extremely pleased" with the development, but noted that "three other ... fugitives are believed to be on the loose in Mexico and have thus far avoided capture" despite the bounty on their heads.

Neuroscientists propose revolutionary DNA-based approach to map wiring of whole brain

ScienceDaily (Oct. 23, 2012) ? A team of neuroscientists has proposed a new and potentially revolutionary way of obtaining a neuronal connectivity map (the "connectome") of the whole brain of the mouse. The details are set forth in an essay published October 23 in the open-access journal PLOS Biology.

The team, led by Professor Anthony Zador, Ph.D., of Cold Spring Harbor Laboratory, aims to provide a comprehensive account of neural connectivity. At present the only method for obtaining this information with high precision relies on examining individual cell-to-cell contacts (synapses) in electron microscopes. But such methods are slow, expensive and labor-intensive.

Zador and colleagues instead propose to exploit high-throughput DNA sequencing to probe the connectivity of neural circuits at the resolution of single neurons.

"Our method renders the connectivity problem in a format in which the data are readable by currently available high-throughput genome sequencing machines," says Zador. "We propose to do this via a process we're now developing, called BOINC: the barcoding of individual neuronal connections."

The proposal comes at a time when a number of scientific teams in the U.S. are progressing in their efforts to map connections in the mammalian brain. These efforts use injections of tracer dyes or viruses to map neuronal connectivity at a "mesoscopic" scale -- a mid-range resolution that makes it possible to follow neural fibers between brain regions. Other groups are scaling up approaches based on electron microscopy.

Zador's team wants to trace connectivity "beyond the mesoscopic," at the level of synaptic contacts between pairs of individual neurons, throughout the brain. The BOINC barcoding technique, now undergoing proof-of-concept testing, will be able, says Zador, "to provide immediate insight into the computations that a circuit performs." In practice, he adds, most neural computations are not currently understood at this level of precision, partly because detailed circuit information is not available for mammals. The BOINC method promises to be much faster and cheaper than approaches based on electron microscopy, Zador says.

The BOINC method consists of three steps. First, each neuron is labeled with a specific DNA barcode. A barcode consisting of just 20 random DNA "letters" can uniquely label a trillion neurons -- many more than exist in the mouse brain.

The second step looks at neurons that are synaptically connected, and associates their respective barcodes with one other. One way to do this is by exploiting a virus such as the pseudorabies virus, which can move genetic material across synapses.

"To share barcodes across synapses, the virus must be engineered to carry the barcode within its own genetic sequence," explains Zador. "After the virus spreads across synapses, each neuron effectively ends up as a bag of barcodes, comprising its own code and those from synaptically coupled partners."

The third step involves joining barcodes from synaptically connected neurons to make single pieces of DNA, which can then be read via existing high-throughput DNA sequencing methods. These double-barcode sequences can then be analyzed computationally to reveal the synaptic wiring diagram of the brain.

Taken together, says Zador, if BOINC succeeds in its current proof-of-concept tests, it will offer a dramatically inexpensive and rapid means of assembling a connectome, even of the complex brains of mammals.

Tibetan finch's 80-year absence

It has been missing for 80 years but Sillem's Mountain Finch has now been rediscovered on the Tibetan plateau by a trekker who was too ill to leave camp.

The mountain finch has been an enigma ever since its discovery in 1929, not least because it wasn't identified until 1992.

Two specimens of the sparrow-sized grey and white bird with a russet head were collected by Dutch ornithologist Jerome Alexander Sillem on an expedition to the Karakoram mountain range in 1929.

Nowadays this is the disputed border region of China, India and Pakistan and a no-go area for birders.

The specimens were labelled as a race of Brandt's Mountain Finch (Leucosticte brandti) and consigned to a drawer in the Amsterdam Zoological Museum.

And there they remained until 1992 when a modern-day Dutch ornithologist, Kees Roselaar, opened the drawer and realised the two specimens were a distinctive species in their own right. And he named the new species Leucosticte sillemi - after the original finder.

Fortunate misfortune

But then the trail went cold - until June this year when French nature photographer Yann Muzika was trekking in the Yenigou valley of Qinghai province in China. However, he contracted food poisoning on the eve of departure and was soon confined to camp.

Yann takes up the story: "After the second day, I decided to take a day break and explore the surroundings as much as my condition would allow.

"It was a trek, not a birdwatching trip, but I was nevertheless carrying a camera and a 400mm lens, just in case.

"I came across a flock of Tibetan Rosefinches (Carpodacus roborowskii) and with them there was a single bird that I did not know, resembling a Brandt's Mountain Finch but with a rufous head instead of dark brown. I took one picture before the bird flew away.

He told BBC News: "When I saw the excellent photo of the mystery bird my immediate thought was Sillem's Mountain Finch! However, being of a cautious disposition I did quite a bit of checking and consultation with others.

"Now we are pretty sure that it is Sillem's Mountain Finch, especially since it has been endorsed by Kees Roselaar, who simply said: 'Fantastic! At last the proof that sillemi still exists'."

The June 2012 bird was found 1,500km to the east of the original sighting in 1929 and the Oriental Bird Club is now urging birdwatchers to search for the bird above 5,000m over a vast swathe of high altitude Pakistan, China and Tibet.

    Lack of sleep tied to teen sports injuries

    ScienceDaily (Oct. 21, 2012) ? Adolescent athletes who slept eight or more hours each night were 68 percent less likely to be injured than athletes who regularly slept less, according to an abstract presented Oct. 21, at the American Academy of Pediatrics (AAP) National Conference and Exhibition in New Orleans.

    For the abstract, "Lack of Sleep is Associated with Increased Risk of Injury in Adolescent Athletes," researchers asked middle and high school athletes (grades 7 to 12) enrolled at the Harvard-Westlake School in Studio City, Calif., to answer questions about the number of sports they played and the time they committed to athletics (at school and through other programs), whether they used a private coach, whether they participated in strength training, how much sleep they got on average each night, and how much they subjectively enjoyed their athletic participation. Seventy percent of the student athletes (112 out of 160 students; 54 males and 58 females; mean age 15) completed the survey, conducted in conjunction with Children's Hospital Los Angeles. Researchers then reviewed those students' school records pertaining to reported athletic injuries.

    Hours of sleep per night was significantly associated with a decreased likelihood of injury, according to the study results. In addition, the higher the grade level of the athlete, the greater the likelihood of injury -- 2.3 times greater for each additional grade in school. Gender, weeks of participating in sports per year, hours of participation per week, number of sports, strength training, private coaching and subjective assessments of "having fun in sports" were not significantly associated with injury.

    "While other studies have shown that lack of sleep can affect cognitive skills and fine motor skills, nobody has really looked at this subject in terms of the adolescent athletic population," said study author Matthew Milewski, MD.

    "When we started this study, we thought the amount of sports played, year-round play, and increased specialization in sports would be much more important for injury risk," said Dr. Milewski. Instead, "what we found is that the two most important facts were hours of sleep and grade in school."

    The advanced age risk may reflect a cumulative risk for injury after playing three or four years at the high school level, Milewski said, and older athletes are bigger, faster and stronger.

    What Will a Housing Recovery Look Like? | The Niche Report

    (TheNicheReport) ? September was a great month for the American housing market. The rate of new residential construction projects rose by 15 percent. Housing permits increased by 11.6 percent. Existing home sales fell by 1.7 percent in September, but on a year-over-year basis they were up by 11 percent.?

    The encouraging September figures are part of a positive trend that has been observed for most of 2012. Data from the U.S. Commerce Department and the National Association of Realtors point to uniform improvement after five years of negative sentiment and poor performance. It would not be unreasonable to expect similar figures in the following months ?at least as long as other economic sectors continue to improve.?

    Interdependency of Sectors?

    The housing market is not the only economic sector riding a wave of improvement. Consumer sentiment in the U.S. has improved along with national employment figures. Auto sales are at the highest levels since the first quarter of 2008. From an economic recovery point of view, the growth in the housing has outpaced other sectors and outperformed expectations by economists.?

    At the present time, the housing sector is contributing 2.39 percent of the Gross Domestic Product (GDP). In the late 20th century, that contribution was at 4.07 percent. In the midst of the housing bubble, other sectors of the U.S. economy were bolstered by residential construction activity and home sales; that trend seems to have reversed in recent months. The positive construction numbers in September are still shy of the levels seen in the last housing recession of the early 1980s.?

    Long-Term Scenarios

    Should the overall economic recovery seen from January through July of 2012 continue at the same pace until December, the contribution by the housing sector to the GDP would be 3.25 percent. This would translate into more than a million new homes built by September 2013.?

    The problem with the scenario above is that it relies on other sectors of the economy, but it is not far-fetched. The median home price is one of the factors supporting this scenario, and the recent annual price improvement is the same as it was at the peak of the housing bubble in late 2005. To give the scenario a better perspective, the current annual rate of home sales is at 4.75 million, and that rate was 7.25 million in September 2005.

    How to Have a Parenting "Do-Over", Parenting Kids, Christian Parents

    I remember when Mark and I took a parenting class and learned about expecting first time obedience from our kids. Our habit, up to that point, had been to count to three, or to threaten, or to get angry.

    Now we had a different vision for our family and for discipline in our home. But how do you change mid-stream? How do you handle a change in expectations, discipline, or how you will parent in the future?

    Mark and I have had to do this over the years when we?ve realized that we?ve either allowed something we shouldn?t, or haven?t parented well or consistently. We call a family meeting and talk to the kids about what we?ve realized or what we?re learning.?

    If you find yourself needing a parenting ?do-over,? consider taking these steps:

    1) Tell your child/children of the upcoming change. One mom had allowed her daughter to sleep in her bed with her. When she realized this wasn?t healthy for her daughter or her marriage, she sat her daughter down and explained that ?beginning tomorrow night, you will sleep in your own bed.? This gave her daughter a heads up and a time of adjustment.

    2) Apologize to your kids, if needed. ?An apology isn?t a sign of weakness?in the parenting realm it?s a sign of strength. Your kids will understand that you make mistakes and that you know what to do to clean up your mistakes. ?

    3) Train to the new expectation. ?If your kids are old enough, do some role-playing to train them to the new standard. ?

    4) Give a grace period. ?When we introduced first-time obedience, we trained for several days and then we began our grace period. It was one week of having the new expectation in place, but if they responded inappropriately, they were reminded of the standard and told that after the grace week, they will receive a consequence for that kind of a response.

    5) Be willing to be the parent. ?The standard is set, the training done, and the practice time is over. Now it?s time to stand firm on your new direction. Most parents find if they are consistent with communication, expectations, and accountability, they are able to move in the direction they desire to go. If you?re dealing with teens, you probably won?t need the training, but the communication, grace period, and consistent accountability will do the trick.?

    Suicide attacker kills 2 near mosque in Iran

    TEHRAN, Iran (AP) ? A suicide attacker running from the police detonated his explosives near a mosque in southeastern Iran on Friday, killing two people, Iranian state media said.

    State television described the incident in a volatile region near the Pakistani border as a "terrorist attack."

    It said a suspect tried to enter the Imam Hossein mosque in Chabahar port as people gathered for Friday prayers, but was stopped by security guards.

    As he started to run away, he set off his explosives, killing two passers-by and wounding several people, including policemen. It was unclear if the explosives were detonated by accident.

    No group claimed responsibility for the attack but the Sunni militant Jundallah group, which claims to be fighting for Sunni rights in the mainly Shiite Iran, has been involved in sporadic bombings in the region in the past.

    In an obvious reference to Jundallah, lawmaker Yaqoub Jedgal blamed the explosion on "remnants of terrorist groups," according to the semi-official ISNA news agency. Jedgal is a representative from Chabahar in the Iranian parliament.

    Jandalla's insurgency in the southeast suffered a significant setback in 2010, when Iranian authorities arrested and later executed the group's leader, Abdulmalik Rigi.

    Religious leaders urge Md. voters to support marriage law ...

    Maryland and D.C. clergy on Thursday urged voters to support the state?s same-sex marriage law during press conferences in Baltimore and in Silver Spring.

    ?We?re here today to support voting for Question 6,? said Rev. MacArthur Flourney, faith director of Marylanders for Marriage Equality, the group defending the law, outside St. Mark?s Episcopal Church in Silver Spring. ?At the end of the day, we see this as about justice and equality. Really this is about fairness. This is about a matter of the state, civil law protecting all families under the law.?

    Rabbi Susan Grossman of Beth Shalom Congregation in Columbia echoed Flourney during the Silver Spring press conference.

    ?We cannot in good conscience deny to our gay and lesbian friends and family the same opportunity for companionship, for marriage and for family that we claim for ourselves,? she said. ?That is why I support the Civil Marriage Protection Act and will vote for Question 6 this November, as will my congregants.?

    Reverend Matt Braddock, senior minister at Christ Congregational United Church of Christ in Silver Spring, spoke about how he and his wife recently celebrated their wedding anniversary at a local restaurant as he urged Marylanders to vote for Question 6.

    ?My faith believes that the Bible celebrates human expressions of love and partnership and call us to live out that gift of God in responsible, faithful, committed relationships that respect the image of God in all people,? said Braddock. ?My faith believes that laws which fail to recognize gay and lesbian marriages contribute to a climate of misunderstanding and division and increased hostility against gays and lesbians and it?s unacceptable. My faith affirms equal marriage rights for couples regardless of gender and declares that the government should offer civil marriages to all couples who want to share fully and equally in the rights and responsibilities and commitments of legally recognized marriage.?

    The press conferences took place the same day Marylanders for Marriage Equality released a new web video that features Rev. Al Sharpton, Rev. Delman Coates of Mount Ennon Baptist Church in Clinton in Prince George?s County and other prominent black faith leaders from across the country who back Question 6. A Washington Post poll released on Thursday indicates 52 percent of likely Maryland voters would support the state?s same-sex marriage law in the Nov. 6 referendum.

    A Maryland Marriage Alliance ad that features Dr. Angela McCaskill, the Gallaudet University administrator suspended earlier this month for signing the petition that prompted a referendum on the same-sex marriage law Gov. Martin O?Malley signed in March, claims those ?who believe in traditional marriage have been punished.?

    The clergy who attended the Silver Spring press conference declined to answer questions about the ongoing controversy over Gallaudet President T. Alan Hurwitz?s decision to place McCaskill, who is the D.C. university?s chief diversity officer, on administrative leave. Coates maintained that the law protects religious freedom.

    ?The Civil Marriage Protection Act allows us to make sure the government protects all families and all residents of our state equally under the law and at the same time provides sufficient language that allows religious institutions to define the religious rite of marriage in accordance with their beliefs and practices,? said Coates. ?There is nothing in the Civil Marriage Protection Act that forces any individual religious clergyperson or religious congregation to perform a same-sex marriage if it?s against their beliefs and practices and yet the legislation ensures that the state protects all residents of our state equally under the law.?

    Sister Jeannine Gramick, co-founder of New Ways Ministry in Mount Rainier, acknowledged Baltimore Archbishop Bill Lori and other area Catholic bishops oppose marriage rights for same-sex couples. She said she is voting for Question 6 because ?it nourishes my own moral development.?

    ?As we grow in the moral right, we sometimes have to make conscience decisions that are at odds with the leaders of our religious denomination,? said Gramick. ?I do respect the position of the Catholic bishops on this question, but I disagree with them and I disagree with them because my conscience tells me so. My conscience tells me that social justice teaching in my church? supports equality and dignity for every individual. And so I can apply that social justice teaching of my church to the question of civil marriage for lesbian and gay people. This is not a question of church doctrine. It?s a question of public policy. And in this area of public policy I respectfully disagree with the bishops of my church.?

    Bishop Mariann Edgar Budde of the Episcopal Diocese of Washington that includes Montgomery, Prince George?s, Charles and St. Mary?s Counties, also acknowledged these differences. Bishop Harry Jackson of Hope Christian Church in Beltsville and Family Research Council President Tony Perkins are among those scheduled to attend a ?Marry Protection Rally? at New Harvest Ministries, Inc., in Baltimore on Sunday.

    ?We know that religious leaders and communities are not of one mind when it comes to marriage equality, said Budde. ?It?s important to remember that the Civil Marriage Protection Act strongly preserves religious freedom. No clergyperson will ever be forced to preside at a wedding for anyone. No faith community will be required to go against their religious beliefs.?

    Budde also referenced her own faith during the Silver Spring press conference.

    ?Jesus taught us to love one another as God loves us, not to judge one another and that all human beings are created in God?s image,? she said. ?Jesus also taught us that we know one another by our fruits and I can personally testify to the loving example of countless gay and lesbian couples who have been an inspiration to me and my husband in our marriage. And so I am thrilled to stand here in support of Question 6 and invite all Maryland voters to vote yes. If they do, countless Marylanders will be so overjoyed. This is a matter of decency and fairness.?

    (CNN) ? When Baltimore Ravens linebacker Brendon Ayanbadejo spoke out in August in favor of a Maryland ballot initiative that would legalize gay marriage, state Delegate Emmett C. Burns Jr. wrote a letter to Ravens owner, Steve Bisciotti saying that many football fans are ?opposed to such a view? and suggesting that Bisciotti ?inhibit such expressions? from his employee.

    Ayanbadejo, one of the first pro athletes to publicly support gay marriage, saw Burns? efforts to stifle him as a violation of his First Amendment rights.

    On September 7, Minnesota Vikings punter Chris Kluwe?s penned a scathing response to Burns, stating, among other things: ?I can assure you that gay people getting married will have zero effect on your life. They won?t come into your house and steal your children. They won?t magically turn you into a lustful c**kmonster.?

    In an interview with CNN?s Poppy Harlow, Kluwe attributed the ?lustful c**kmonster? bit to the fact that he developed a talent for coming up with attention-grabbing message board postings after growing up playing a lot of online video games.

    ?If you can?t make a point that sticks in someone?s mind,? Kluwe explained, ?most people probably won?t really listen to you. So I developed a writing style that combined logical presentation of facts with hopefully some pretty hilarious insults.?

    Colorful language aside, Kluwe was trying to make a serious point. He hoped that calling Burns out would spark a genuine conversation about the issues highlighted in the letter.

    Professional athletes, on the whole, aren?t as outspoken as Kluwe when it comes to gay marriage and other hot-button issues. For the most part, they keep low profiles because they don?t want to upset fans, risk endorsement deals or disappoint their coaches.

    Jackie Robinson, the first black man to play in the majors since the 1800s, desegregated Major League Baseball in 1947 when he joined the Brooklyn Dodgers.

    Robinson let his talent speak for itself, playing in six World Series with the Dodgers, until his playing career was over and he became an advocate for civil rights. Recognized as a hero of the era, Robinson is the only player ever to have his jersey number ? 42 ? retired across the board by every Major League team.

    In 1966, when he became eligible for the draft during the Vietnam War, boxer Muhammad Ali declared himself a conscientious objector. That same year, the heavyweight champion also delivered the ?Black is Best? speech to 4,000 students at Howard University upon being invited to speak by the campus protest group Black Power Committee.

    For refusing to enlist, Ali was arrested, fined and stripped of his title, and for more than three years he could not box in any state in the U.S. In 1967, Ali was convicted of violating United States Selective Service laws by refusing to be drafted.

    As public opposition to the war grew, Ali delivered speeches across the country, at one point asking, ?Why should they ask me to put on a uniform and go 10,000 miles from home and drop bombs and bullets on brown people in Vietnam while so-called negro people in Louisville are treated like dogs and denied simple human rights??

    Ali?s conviction was overturned by the Supreme Court in 1971.

    The outspoken Alis, however, were few and far between.

    In 1990, for example, Michael Jordan declined to endorse Democratic North Carolina Senate candidate Harvey Gantt, saying ?Republicans buy shoes, too.?

    Times have changed, and this past summer, Jordan helped President Barack Obama?s re-election campaign net $3 million at a $20,000-a-plate fundraising dinner.

    While the majority of professional athletes today still adopt a laissez-faire attitude toward taking a stand on controversial issues, the tide is slowly turning.

    Cleveland Browns linebacker Scott Fujita, a longtime advocate for NFL player safety, publicly accused Commissioner Roger Goodell this month of abusing his power by not being more vigilant about health and safety issues concerning players.

    ?He failed to acknowledge a link between concussions (and) post-career brain disease,? Fujita said in a statement, ?pushed for an 18-game regular season, committed to a full season of Thursday night games, has continually challenged players? rights to file workers? compensation claims for on-the-job injuries, and he employed incompetent replacement officials for the start of the 2012 season. His actions or lack thereof are, by the league?s own definition, ?conduct detrimental.? ?

    Goodell maintained that Fujita, a former New Orleans Saints team captain, should have done more to stop players from participating in a team bounty program. That scandal involved several Saints defensive players who were discovered to have secretly managed a pool of money from which bonuses were awarded to players who injured opponents between 2009 and 2011.

    Goodell suspended Fujita for three games but reduced that suspension to one, acknowledging that Fujita did not participate in Bountygate.

    In Minnesota, as residents prepare to vote on an amendment to ban gay marriage, Kluwe remains outspoken.

    ?It would be great if Minnesota could show America that this state treats people the right way and knows that gay people contribute just as much to society as straight people,? Kluwe said.

    Although he himself is not a homosexual, Kluwe posed for the November cover of Out magazine. He noted that historically ? though most sports figures are reluctant to do so ? it has often been professional athletes who have brought about awareness of issues like gay marriage and civil rights.

    ?When sports gets on board with a civil issue, then that issue is rapidly resolved in the next, you know, 10, 15 years,? he said. ?Sports speaks to a large segment of the population, and when kids look at athletes as role models, they say, ?OK, hey, these guys are saying it?s OK if you?re gay, it?s OK to have same-sex marriage.? ?

    Kluwe maintains that, despite his outspokenness, he has no plans to become a politician after his playing days are over. He hopes that one day, it won?t be necessary for him to defend the issue of gay marriage.
